This article comments on the recent study “CEO hubris and firm pollution: state and market contingencies in a transitional economy” of Zhang et al. :459–478, 2020) in this journal. We very much appreciate the valuable initiative of Zhang et al. to study the potential effect of CEO characteristics on corporate pollution. At the same time, we are concerned with the authors’ interpretation of the regression results and their operationalization of CEO hubris. We hope to contribute to the literature on managerial (...) hubris in two ways. First, we repair the authors’ inferences and conclusions about the actual effect of CEO hubris on firm pollution with respect to their conflicting regression results. Second, we unpack and clarify the authors’ vulnerable operationalization of CEO hubris. We hope to stimulate more research on the relationship between CEO hubris and firm pollution, and managerial hubris more generally through a more rigorous operationalization and measurement of hubris. How should judges deal with the manifestation of religious symbols in public educational institutions? In light of the important role of human rights in our legal and political system, courts should grant maximum protection under the freedom of religion or belief. The central thesis of this article is that the European Court of Human Rights fails to live up to this standard. In order to reach this conclusion, the article analyzes relevant case law of the European Court and compares its (...) case law with that of the high courts of Canada and South Africa. In addition, the article assesses the case law of all three courts from the angle of interpretation theory and particularly Cass R. Sunstein’s theory of judicial minimalism. Adoption of a more consistently minimalist methodology by the European Court might lead to a greater protection granted to individuals and groups. However, a wide and deep ruling is first required to overturn the current line of reasoning. The European Court can draw inspiration from Canada and South Africa for such a judgment. (shrink)

Im Zuge der fortschreitenden Globalisierung der Wirtschaft kooperieren Wirtschaftsakteure immer häufiger mit Partnern in anderen Teilen der Welt, die anderen kulturellen Rahmenbedingungen verpflichtet sind. Dabei treten oft Handlungs- und Normkonflikte auf. Das vorliegende Buch behandelt diese transkulturellen Wertekonflikte aus unterschiedlichen philosophischen und wirtschaftsethischen Perspektiven: Grundsatzfragen der Transkulturalität, wie die Gefahr des Verlusts des Fremden werden ebenso behandelt wie der mögliche Umgang mit transkulturellen Wertekonflikten oder die Frage nach einer ökonomischen Moral. Es gibt offensichtlich nicht nur Moden der Kleidung, der Frisur oder des Wohnens, sondern auch Moden in den Wissenschaften, in Kunst, Philosophie und vielleicht sogar in der Religion. Das heisst aber gerade in Bereichen, die doch eigentlich 'feste Prinzipien' gegen den Wechsel des Zeitgeistes und der Moden verteidigen. Aber was bedeutet dann in diesen Zusammenhängen "Mode"? Und wie lassen sich solche geistigen Moden erklären? Gehören "Mode" und "Moderne" zusammen? Der vorliegende Band versucht eine systematische Antwort auf diese Fragen, indem er (...) zunächst das Phänomen des Modischen auf seinen offenkundigen Feldern untersucht: den Kleidungsmoden, Wohnmoden, Körpermoden und den Moden in Freizeitgestaltung und Tourismus sowie im Sport. Nach einer neueren, angloamerikanischen Forschungsthese ist Phantasie bei Aristoteles keine bloß repräsentierende Einbildungskraft, sondern das Vermögen, die blinden Daten der Wahrnehmung zu interpretieren und ihnen allererst gegenständlich informative Bestimmtheit zu verleihen. Folgende Abhandlung zeigt, daß diese Deutung auf einem Mißverständnis der dunklen zentralen Textstelle De anima III 3 beruht. Während Aristoteles den strengen Begriff der Phantasie von ihrem metaphorischen Begriff unterscheidet, führt die Verwechslung beider Aspekte zu einer Subjektivierung der Wahrnehmung und zu einer Kognitivierung der Phantasie, die bei Aristoteles ein (...) rein sinnliches Vermögen ist. Dadurch wird die deutliche Zäsur in der Begriffsgeschichte von phantasia, imaginatio und Einbildungskraft eingetrübt, die Aristoteles und die Antike von Avicena und Kant trennt. (shrink)

In this study the present writer tried to restrict himself totally to this subject: viz. to give an exposition of Spinoza's methodology in its totality. He tried to give a modern approach in that he was primarily not concerned with the historical roots of Spinoza's ideas, but with the way in which these ideas function in his philosophy...... Cusanus hatte es in seinem Leben und in seinem Werk mit einer Fulle von Konflikten verschiedenster Art zu tun: juristische, kirchenpolitische, philosophische und theologische Konflikte. Gibt es Prinzipien, die Nikolaus von Kues bei den jeweiligen Konfliktlosungen leiteten? Der Verfasser bejaht diese Frage und subsumiert abschliessend die erarbeiteten Prinzipien unter den Begriff <I>ordo im Sinne des Titels der Arbeit.".

An analysis is presented of published methods that have been used by experimenters to justify the reliability of the theory of invasion of microorganisms into cultured cells. The results show that, to demonstrate this invasion, many experimenters used two or more methods that were based on independent technical and theoretical principles, and by doing so improved the reliability of the theory. Subsequently I compare this strategy of 'multiple derivability' with other strategies, discussed in the literature in relation to the mesosome, (...) a bacterial organelle that had been detected with the electron microsope, but which appeared later to be an artifact. I propose that different strategies have been applied in this problem, and multiple derivability may have been the decisive one. Finally I discuss the idea that multiple derivability may help to anchor theories in a larger network of theories. (shrink)

This article aims to read feminist new materialisms (Barad), together with ‘postulated’ linguistic or cultural primacy of Queer Theory (Butler), to show how both are engaged in similar critical-ethical endeavours. The central argument is that the criticism of Barad and new materialisms misses Butler’s materialistic insights due to a narrow interpretation of Butler's alleged social-constructivist position. There is, therefore, a specific focus on where they both make similar ethical appeals. Moreover, the article relies on Adorno's negative dialectic to highlight an (...) interpretation of Barad and Butler as being part of the same dialectical movement, in which materialism and idealism fluctuate in their mutual criticisms, thus continuing the procession towards 'new knowledge' and emancipation, or freedom, through their motions back and forth.
